Never pay up front fees to anyone who says to you, “I can help  save your home and modify your loan.”  Help does exist, however, it does not come with an up front cost and one option may not be the right option for another home owner. As a consumer facing foreclosure it is important that you become knowledgeable and explore  all of your options. Many times when people think of their upside down mortgage they think of loan modification, when they call their bank the bank says you have to be delinquent on your mortgage in order to qualify. SO people stop paying their mortgage, but STOP, before you do anything like stop paying your mortgage, explore all of your options, modification, Short Refinance(HARP)(you cannot be delinquent on your mortgage), Bankruptcy, Foreclosure, & Short Sale.
Never pay anyone up front in hopes that they will change your loan or save your home even if they are licensed or certified. Talk to Realtors, CPAs, and Attorneys. Get second opinions. Only individuals who are licensed Realtors, Loan Officers, Attorneys or entities approved by the Department of Real Estate can legally help you with your mortgage modification, short sale or refinance. Never pay these people upfront.

Many people today are in a position to ask themselves ‘Do I Short Sale my home, let it go into Foreclosure or file for Bankruptcy’?  The answer to this question is not as easy as one would think.  In today’s Real Estate market, I find many people asking themselves the question but never follow through with an answer.
This is a complex questions and what is right for one person might not be right for another.  That is why many realtors stress to their clients the importance of speaking with their accountant or an attorney to assist them in choosing the right course of action to take when dealing with their real estate matters.
Presently, there are many atricles out there addressing this subject.  I caution everyone on reading these articles and taking action before speaking with a reputable attorney or tax accountant.  It is important to know what the consequences will be no matter what action is taken. 
While a Real Estate Agent is not allowed to give legal advise, they are a good source for references.  You might also speak with your neighbors and see who they may know or have heard about regarding this issue.
